Privacy Policy

Effective Date: 10/8/2026 | Last Updated: 10/2026

1. Who We Are and What This Policy Covers

Sports Academy Management, LLC ("Club Apple," "we," "us," or "our") operates theclubapple.com (the "Site"), the Club Apple member app for iOS and Android (the "App"), and the memberships, classes, and related services we offer (together, the "Services"). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices you have.

This Policy applies to information we collect through the Site and App, and through offline interactions such as phone calls, front-desk check-in, and visits to our facilities. It is part of, and subject to, our Terms of Use, including the SMS Communications Terms and Conditions in Section 7 of the Terms. If this Policy and the Terms conflict, the Terms govern. By using the Site, App, or Services, you acknowledge the practices described here.

Our Site and Services are not available to minors. See Section 11.

2. Information We Collect

Information you give us. We collect information when you create an account, sign up for a membership or free trial, fill out a form, contact us, subscribe to updates, enroll in classes, or opt in to text messages. Depending on what you do, this may include:

  • Contact details, such as your name, email address, mailing address, and mobile phone number

  • Account details, such as your username and password

  • Membership and billing details, such as the plan you choose, purchase history, and billing status

  • Emergency contact information you choose to provide

  • Your communication preferences, including text message and email consent records

  • The content of messages you send us, and any other information you choose to submit

Information collected automatically. When you use the Site or App, we and our service providers may automatically collect your IP address, device and browser type, operating system, pages and screens viewed, referring pages, date and time of visits, and similar usage data. In the App, this may also include check-in and class booking activity. If you allow the App to access your device's location, we may collect location information as described in Section 10.

Information from other sources. We may receive information about you from service providers that help us operate our business (for example, payment processors or lead-form tools), from social media platforms consistent with your settings on those platforms, and from other third parties that are lawfully entitled to share it with us.

You can choose not to provide certain information, but some features or Services may not be available to you if you do.

3. How We Use Your Information

We use personal information to:

  • Create and manage your account and membership

  • Provide, operate, and improve the Site, App, and Services

  • Analyze how the Site and App are used so we can improve them

  • Comply with legal obligations, enforce our Terms, and protect our rights, property, and safety and those of our members and staff

We do not use personal information for purposes that are incompatible with the reasons we collected it without telling you or getting your consent where required.

4. Text Messages (SMS) and Your Mobile Phone Number

If you provide your mobile phone number and opt in to the Club Apple text messaging program, we may send you transactional and marketing text messages, as described in Section 7 of our Terms of Use.

  • Mobile phone numbers, SMS consent records, and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. Such information may only be shared with service providers as necessary to provide the requested services.

  • Message frequency may vary. Message and data rates may apply.

  • Your consent to receive marketing text messages is not required to purchase any goods or services.

  • To stop receiving text messages, reply STOP at any time. For help, reply HELP or contact us at info@theclubapple.com. If you opt out, we will no longer send you marketing or transactional texts.

5. Email and Other Marketing

If you give us your email address and opt in, we may send you promotional emails about offers, classes, and news from Club Apple. You can unsubscribe at any time using the link at the bottom of any marketing email or by emailing info@theclubapple.com. Even if you opt out of promotional messages, we may still send you important account, billing, and service messages.

6. How We Share Your Information

We do not sell your personal information. We share it only as described in this Policy, including with:

  • Service providers and contractors that help us run the Site, App, and Services, such as hosting, payment processing, membership management, communications, analytics, and customer support providers. They may use your information only to perform services for us and under appropriate confidentiality obligations.

  • Third parties at your direction or with your consent, such as your emergency contact or an authorized representative.

  • Professional advisors, such as attorneys, accountants, and insurers.

  • Legal and safety recipients, when we believe disclosure is required by law, subpoena, or other legal process, or is needed to detect or prevent fraud, protect safety, or enforce our rights and agreements.

  • Business transfer parties, if Club Apple is involved in a merger, acquisition, financing, reorganization, or sale of assets. Personal information may be among the assets transferred.

Mobile phone numbers, SMS consent records, and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. Such information may only be shared with service providers as necessary to provide the requested services.

7. Cookies and Similar Technologies

The Site may use cookies, pixels, and similar technologies. A cookie is a small file stored on your browser or device. We use them to keep the Site working (for example, to keep you signed in), remember your preferences, understand how visitors use the Site, and measure the effectiveness of our communications and advertising.

Third-party analytics and advertising providers may also place cookies or collect usage information on the Site. Their handling of that information is governed by their own privacy policies.

Most browsers let you block or delete cookies through their settings. If you block certain cookies, parts of the Site may not work properly. The Site does not currently respond to browser "Do Not Track" signals.

8. Links to Third-Party Sites and Integrations

The Site may link to third-party websites, and may connect with third-party integrations such as maps, scheduling tools, or payment pages. When you leave the Site or make a payment through an external page, that third party's own terms and privacy policy apply. We are not responsible for the privacy practices of third-party sites or services, and we encourage you to read their policies.

9. Data Retention and Security

We keep personal information for as long as needed to provide the Services, maintain your account and membership, and meet legal, tax, accounting, and dispute-resolution requirements. We may keep information in de-identified or aggregated form that can no longer be associated with you.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your account password confidential and for notifying us right away if you suspect unauthorized access to your account.

If you have questions about your privacy or about what we do if your information is compromised, contact us at info@theclubapple.com.

10. Mobile App

The App lets members manage their account and use member features. The App may collect the information described in Section 2. If you allow it, the App may use your device's location to provide location-based features. You can change or revoke location and notification permissions at any time in your device settings. Downloading or using the App is also subject to our Terms of Use and, for iPhone and iPad, the Apple Licensed Application End User License Agreement.

11. Children's Privacy

The Site and Services are not directed to, and are not available to, individuals under 18. We do not knowingly collect personal information from minors through the Site or App. If you believe a minor has provided us personal information, contact us at info@theclubapple.com and we will take steps to delete it.

12. Your Choices and Privacy Rights

You can:

  • Access and correct. Ask us what personal information we hold about you and request corrections to anything inaccurate or incomplete. You can also update some account details directly in your account.

  • Delete. Request deletion of your personal information, subject to exceptions such as legal, billing, and security needs.

  • Opt out of marketing. Unsubscribe from marketing emails using the link in the email, and opt out of text messages by replying STOP.

  • Control cookies. Adjust cookie settings in your browser as described in Section 7.

To make a request, email info@theclubapple.com or write to the address in Section 15. We may need to verify your identity before acting on a request, and we will respond within the time required by applicable law. In some cases we may not be able to fulfill a request, for example where it conflicts with a legal obligation, and we will explain why. We will not discriminate against you for exercising your privacy rights.

Residents of some states have additional rights under state privacy laws, which may include the right to know, access, correct, and delete personal information, to opt out of certain kinds of processing, and to appeal a decision on a request. We honor valid requests from residents of any state to the extent required by applicable law.

13. Changes to This Policy

We may update this Policy from time to time. When we do, we will post the updated version on the Site and change the "Last Updated" date above. If we make material changes, we will provide additional notice on the Site. Your continued use of the Site, App, or Services after an update takes effect means you accept the updated Policy.

14. Governing Law

This Policy is governed by the same governing law and dispute resolution provisions as our Terms of Use, including the arbitration provisions in Section 23 of the Terms.
